Officers shot at suspect who opened fire in Phoenix home, police say

PHOENIX - A suspect is now in custody after he reportedly pointed his gun at officers and opened fire inside a Phoenix home.

Police say they were called to a neighborhood near 39th Avenue and Cactus at around 8:20 p.m. on May 14.

A 911 caller reported that shots were being fired in her backyard. Her grandson told the 911 caller that the shooter was her own son, police said.

An officer who arrived at the scene tried to talk to the man through the door.

Police say the man come out of the door with a handgun and fired several shots at the ground. 

"Both officers took positions of cover and set up containment on the house," said Sgt. Robert Scherer with Phoenix PD.

More officers reported hearing more shots being fired from inside the home.

The suspect then came back outside and raised his gun at police and police opened fire in response but missed. He then went back inside for several more minutes.

"At some point the suspect came out of the house and stood in the doorway and would not listen to verbal commands," said Sgt. Melissa Soliz with Phoenix PD. "A less lethal 40 mm [foam baton] was discharged and hit the suspect, causing him to go back inside the house. A few minutes later he came back out and was taken into custody."

Family members were inside the house at the time, including the 911 caller and several children.

No one was hurt during the incident.

The suspect has been identified as 38-year-old Eberto Juan Hernandez Jr. He was booked into jail and is accused of aggravated assault on an officer.

It's unclear why he had been firing gunshots in the home.

This shooting happened following a string of shootings in the Phoenix area from the night of May 13 into May 14.
