Judge dismisses case against Arizona man accused of killing ex-girlfriend

A murder case involving an Arizona man suspected of killing his ex-girlfriend nearly two years ago has been dismissed without prejudice, meaning prosecutors can refile charges.

Jon Christopher Clark was arrested after the body of 19-year-old Kiera Lanae Bergman was found in Buckeye in September 2018.

The Phoenix woman was last seen alive at her home a month earlier.

Clark was indicted on charges of second-degree murder and tampering with physical evidence.

He pleaded not guilty and his trial was initially set for February 2020.

It was rescheduled twice before Maricopa County Superior Court Judge Ryan Adleman dismissed the case Tuesday.

The judge cited the prosecution’s failure to disclose important, exculpatory evidence in a timely manner and also was critical of the Phoenix Police Department for not following up on Silent Witness tips.

The county Attorney’s Office hasn’t decided yet whether to refile charges against Clark, who was released from custody last month and placed on electric monitoring.
